General terms and conditions for purchasing extra virgin olive oil at Cortijo de Suerte Alta.

These General Contracting Terms (hereinafter, the “Terms”) govern the sale of products through the website www.suertealta.es. By placing an order, you expressly accept these Terms in the version published on the order date.

Los presentes Términos y Condiciones regularán expresamente las relaciones surgidas entre CORTIJO DE SUERTE ALTA, S.L. (en adelante, “SUERTEALTA”), con domicilio social en Calle Encarnación, 4, Bajo izquierda, 28013, Madrid, y con CIF B-84487529 y los terceros (en adelante, “Usuarios”) que se den de alta como usuarios y/o adquieran productos a través de la tienda online del sitio web oficial de SUERTEALTA (https://www.suertealta.es/, en adelante el “Sitio Web”).

Access to the Website implies acceptance of these Terms and Conditions, as well as any modifications and/or additional legal texts that SUERTEALTA may include in the future.
By accepting the Terms and Conditions, the User undertakes to act at all times in accordance with the provisions set out in the clauses of this legal text, which define the rights and obligations of SUERTEALTA and the User with regard to the contractual relationship arising from the use of the services accessible through the Website. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to the fact that specific conditions may exist for certain services) and they replace any other conditions.
By accepting these Terms and Conditions, the User declares that they are over 18 years of age and have the legal capacity to contract and purchase the services offered on the Website.

This Website has been developed by SUERTEALTA for the purpose of offering for sale various types of organic olive oil, such as picual, arbequina, and blends, etc. (hereinafter, the “Products”).
The products are intended for consumer users.

In order for Users to enjoy the products offered by SUERTEALTA through the Website, they must take the following into account:
In order to purchase the Products made available to Users through the Website, they must register by providing their first and last name, as well as their email address and date of birth, using the registration form found on the Website for this purpose. In addition, Users must choose a password in order to complete the registration process.
SUERTEALTA will provide the use of personal passwords to Users who register as such on the Website. These passwords will be used to access the services provided through the Website. The User must keep the passwords under their sole responsibility in the strictest and absolute confidentiality, assuming any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be changed by the User at any time. The User undertakes to immediately notify SUERTEALTA of any unauthorized use of their password and/or username, as well as any unauthorized access by third parties to it, through the email tienda@suertealta.es, in order to proceed with its immediate cancellation.
Once the User has created an access account on the Website, they will have access to a profile where they can complete their personal details, including their date of birth, postal address, and tax identification number.
The User guarantees that their data is accurate, up to date, and truthful. In addition, they may cancel their account on the Website at any time by contacting SUERTEALTA via the email tienda@suertealta.es.
Once the User account has been created, the User may proceed to purchase any of the Products offered on the Website. Once the Products have been selected and added to the cart, the User may choose home delivery and proceed to pay the price.
SUERTEALTA reserves the right to modify the products offered to Users through the Website. In particular, SUERTEALTA may at any time add new products to those offered or included on the Website, it being understood that, unless otherwise stated, these new products will be governed by the provisions of these Terms and Conditions.
The User undertakes, in general, to use the Website, to purchase the products and to use each of the Website’s services diligently, in accordance with the law, morality, public order and the provisions of these Terms and Conditions, and must also refrain from using them in any way that could prevent, damage or impair the normal functioning and enjoyment of the Website by Users, or that could injure or cause damage to the property and rights of SUERTEALTA, its suppliers, Users, or any third party in general.
In particular, but without limitation, any person visiting the Website, as well as Users, must not:
SUERTEALTA shall be entitled to investigate and report any of the aforementioned conduct in accordance with the Law, as well as to cooperate with the authorities in the investigation of such actions.
SUERTEALTA reserves the right to deny any attempt to access the Website or to cancel the provision of Services in cases where the Website is used incorrectly. In particular, SUERTEALTA reserves the right of admission and exclusion from its Website. Any User who fails to comply with the rules contained in these Terms and Conditions may be excluded from the Website.
SUERTEALTA undertakes to resolve any problems that may arise and to offer the User all necessary support in order to reach a quick and satisfactory resolution of the incident, as well as to remove any advertisement published on its Website whose content infringes applicable laws as soon as it becomes aware of its existence.

The products included on the Website will correspond as faithfully as possible to what web display technology allows for the products actually offered. The characteristics of the products and their prices appear on the Website. Prices shown on the Website are in euros (€) and include VAT, unless stated otherwise.
All Products appearing on the Website are subject to availability. SUERTEALTA constantly and automatically updates the Website to ensure the greatest possible correspondence between the actual availability of products and services and the information available in this regard on the Website.
However, SUERTEALTA reserves the right to cancel an order in the event that the Products selected by the User are unavailable, in which case SUERTEALTA will inform the User by email that the order could not be processed, detailing the reasons why the User will not be able to enjoy it. In this case, the amount previously paid will be refunded through the payment method chosen by the User as soon as possible.
The refund actually processed will be communicated to the User by email.

The customer can pay for their order by:
Once the User has selected the Products, they must verify that the contents of their order are correct and proceed to pay for it. In this regard, in order for the User to proceed with payment, they must identify themselves or register beforehand.
Within a maximum period of twenty-four (24) hours, SUERTEALTA will send the User an email confirming receipt of payment. This email will assign a purchase reference code and will detail the product’s characteristics, its price, shipping costs (if applicable), and payment details.
We do not ship to the Canary Islands, Ceuta, or Melilla.
There is no minimum order amount for any of the available destinations.
Shipping costs include handling, packaging, and transport, and are applied according to the order amount and its destination, as follows:
Shipments to Spain (mainland and Balearic Islands): free shipping from €100.
Shipments to European Union countries: free shipping from €150.
Shipments to European countries outside the European Union: free shipping from €250.
For orders whose amount does not reach the applicable threshold for their destination, shipping costs will be calculated based on the destination and shown to the User before order confirmation. If two different orders are placed, shipping costs will apply to each of the orders.
Any customs duties and taxes that may arise when the order enters a country outside the European Union shall be borne by the buyer.
Users who purchase a product through the Website must make payment using one of the following available systems:

El Usuario deberá notificar a SUERTEALTA cualquier cargo indebido o fraudulento que eventualmente pudiera producirse en la tarjeta utilizada para las compras, a través del envío de un correo electrónico a dirección tienda@suertealta.es en el menor plazo de tiempo posible, de forma que SUERTEALTA pueda realizar las gestiones oportunas con motivo de una eventual incidencia.
SUERTEALTA will archive the electronic documents in which the contract is formalized, sending a copy to the User once the purchase has been made.
The order confirmation sent by SUERTEALTA is not valid as an invoice, only as proof of purchase.

SUERTEALTA undertakes to deliver the Product in perfect condition to the address indicated by the User. In order to optimize delivery, the User must provide an address where the order can be delivered during normal business hours.
However, SUERTEALTA will not be liable for errors caused in the delivery of the order when the delivery address entered by the User in the order form is inaccurate, does not correspond to reality, is false, or has been omitted.
Notwithstanding the foregoing, SUERTEALTA undertakes to adopt all measures within its reach so that order deliveries can be made within the agreed time, or otherwise as soon as possible, to the recipient’s satisfaction.
The User may track their order through their user account.
Orders are delivered within 24/72 business hours following receipt of payment confirmation, except for orders received on weekends or public holidays.
In the case of international shipments, the delivery time for the order is 10 business days.

The return of Products with manufacturing defects (such as, for example, defects in the bottling) may be made within a period of 3 years from the acquisition of the Product, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws that may apply.
Defects or damage caused by incorrect use or handling of the Product by the User are not covered by this warranty.
This warranty applies taking into account, in all cases, the nature of the products purchased and their perishable or semi-perishable character, and may not be enforced in every case. However, it should be noted that olive oil is a product that must be stored properly and consumed within a certain period of time from the date of packaging, since over time it may lose some of its organoleptic properties such as smell, taste, or color.
Unless proven otherwise, the Products shall be deemed to conform to the contract provided that they meet all of the following requirements: a) They match the description provided by SUERTEALTA and possess the qualities of the Product that SUERTEALTA presented to the user; b) They are fit for the purposes for which products of the same type are ordinarily used; c) They show the quality and performance customary for a Product of the same type that the consumer and user may reasonably expect, given the nature of the Product.
The return shall be made at no cost to the User, provided it has been agreed with SUERTEALTA and that the transport service for the return has been specifically arranged by SUERTEALTA. Except where the parties have agreed otherwise in writing (email, etc.), SUERTEALTA will not refund any transport costs incurred by the user or arranged by the user personally.
To formalize the return, the User must contact SUERTEALTA using the form provided below in point 8.2, indicating the Product or Products being returned and a detailed account of the defects observed. Once this communication is received, and after the defect in the indicated Product has been verified, the SUERTEALTA customer service team will arrange for collection of the defective Product for shipment to its warehouses, at no cost to the User.
In the event of a defective Product, SUERTEALTA will proceed, as applicable, with the repair, replacement, price reduction or termination of the contract, at no cost to the User.
The User has the right to withdraw from the contract within 14 calendar days from the day they received the Products, without penalty and without needing to give a reason. The withdrawal period will expire 14 calendar days after the day on which the User, or a third party other than the carrier indicated by the User, acquired physical possession of the last of those goods.
To exercise the right of withdrawal, the User must notify SUERTEALTA – Calle Encarnación, 4, Bajo izquierda, 28013, Madrid – tienda@suertealta.es of their decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or email). To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of this right to be sent before the corresponding deadline expires.

In the event of withdrawal, SUERTEALTA will refund all payments received from the User, including delivery costs (except for any additional costs resulting from the User’s choice of a delivery method other than the least expensive standard delivery method offered by SUERTEALTA), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract.
SUERTEALTA will make such refund using the same payment method used by the User for the initial transaction, unless the User has expressly indicated otherwise; in any event, the User will not incur any costs as a result of the refund. SUERTEALTA may withhold the refund until it has received the Products, or until the User has provided proof of having returned them, whichever condition is met first.
The right of withdrawal will not apply where the goods have been unsealed after delivery and are no longer suitable for return for reasons of hygiene.

For any incident, complaint or exercise of their rights, the user may send an email to the address tienda@suertealta.es.

SUERTEALTA does not provide any warranty nor accept any liability, in any case, for damages of any kind that may arise from access to or use of the content of the Website. Among others, and by way of example and not limitation, SUERTEALTA is not responsible for the following circumstances:

The User acknowledges that all elements of the Website and of each of the products, the information and materials contained therein, the trademarks, the structure, selection and presentation of its content, and the computer programs used in connection with them, are protected by intellectual and industrial property rights belonging to SUERTEALTA itself or to third parties, and that the Terms and Conditions do not grant the User, with respect to such industrial and intellectual property rights, any right other than those specifically provided for herein.
Pursuant to the provisions of Royal Legislative Decree 1/1996, of April 12, approving the consolidated text of the Intellectual Property Law, regularizing, clarifying and harmonizing the legal provisions in force on this matter (hereinafter, the “Intellectual Property Law”), as well as Law 17/2001, of December 7, on Trademarks and complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution, and public communication, including its making-available form, of all or part of the contents of the Website, by any means or through any technical medium, is expressly prohibited, except with express authorization granted in writing by SUERTEALTA.
Specifically, and pursuant to the provisions of national, European and international regulations on intellectual property, the use of all or part of the contents of this website is expressly prohibited, and specifically the content produced by SUERTEALTA, for commercial purposes, by any means or through any technical medium, without the authorization of SUERTEALTA.
The User must use the materials, elements and information accessed through the use of the Website solely for their own needs, undertaking not to carry out, either directly or indirectly, any commercial exploitation of the materials, elements and information obtained through them.
The User undertakes to respect the Intellectual and Industrial Property rights held by SUERTEALTA. The User must refrain from removing, altering, circumventing or manipulating any protection device or security system installed on SUERTEALTA’s Website.
SUERTEALTA does not grant any license or authorization of any kind over its intellectual and industrial property rights or over any other property or right related to the Website, and it shall in no case be understood that access to and browsing of the Website by Users implies a total or partial waiver, transmission, license or assignment of such rights by SUERTEALTA.
Any use of such content not previously authorized by SUERTEALTA shall be considered a serious breach of intellectual or industrial property rights and shall give rise to the legally established liabilities.

SUERTEALTA guarantees the security and confidentiality of the personal data provided by Users in compliance with the provisions of Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (hereinafter, the “GDPR”) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (hereinafter, the “LOPDGDD”). In this regard, Users are informed that, with respect to the privacy and protection of their personal data, they may exercise the following rights:

The information appearing on this Website is current as of the date of its last update. SUERTEALTA reserves the right to update, modify or remove information on this Website, as well as these Terms and Conditions, the privacy policy or any other information.
The entry into force of any modifications to the terms and conditions shall take effect from the moment of their publication on this Website.
